People Seize Castlebar Court After Judge Flees

Integrity Ireland members attempt to place judge and garda superintendent under citizens’ arrest

This morning's sitting of Castlebar Court today was adjourned just before midday as members of Integrity Ireland requested to place Judge Kevin Kilrane and prosecuting Superintendent Joe McKenna under citizens’ arrest.

Stephen Manning and Colm Granahan both of Integrity Ireland had been taking a private criminal prosecution of County Registrar Fintan Murphy. The Garda Sergeant who starred in an I-I all-action video clip in March had also been summoned to appear as a witness - for the prosecution.

Well, history was made today.. but it wasn't all good. The case against Garda Sgt Hanley was thrown out on a technicality, and 'papers' were 'served' on Colm late last night purporting to be a High Court Order preventing the hearing vs Registrar Fintan Murphy going ahead.. This sets a very dangerous precedent - when a valid prosecution can be stopped even before it has begun (the first time in the history of the State) - and where legitimate summonses are completely ignored by the accused!
(Apparently - those rules only apply to us!) There were so many barefaced breaches of the law and Court rules today as to beggar belief! The whole set-up was so obviously contrived that the judge was openly jeered at and ridiculed by the public for the best part of an hour..

Here is a very tame account of what transpired.. The part that the reporter DIDN'T see was when we (the public present) nominated our own judge (video footage to follow soon), who duly took her seat on the bench and continued with business..

This is taken from https://thegubugazzette.wordpress.com/2015/09/02/histor...king/ which is a good account of what happened.

Castlebar District Court was the place to be today, for what was witnessed was a spark on the verge of bursting into an almighty flame.

In courtroom 1, Judge Kevin Kilraine was asked to issue a warrant for the arrest of two individuals who should have been present – namely, County Registrar, Fintan Murphy, and Garda Sergeant Peter Hanley.

Judge Kilraine refused, and tellingly, he would not give an explanation.

He would not, or could not, answer as to why these two persons did not attend the court.

However, if you or I had been subpoenaed, as these two individuals were, we are under an obligation to attend. Indeed, we actually have no choice – we have to. If we don’t, the sitting judge would issue an order for our arrest.

But, in this case, this did not happen.

The question is, why?

It doesn’t take a genius to work that out – both of these individuals are employed by the State, for the State.

If Judge Kilraine had issued the warrant this would bring down the State corruption, in turn showing the judicial collusion, along with its policing to its core.

What Judge Kevin Kilraine chose to do instead, was to protect corruption, but the people in this public courtroom didn’t like this, or want this – not one little bit.

Judge Kilraine blatantly showed that the rule of law for one, is different for another.

Gradually, the public gallery got more stirred up. They sat up and listened intently to what was going on. Even the guys that were there on whatever charges were looking around enthralled, and were whispering excitedly, ‘what is going on’?!

What was going on, and Kevin Kilraine knew it, is the beginning of the end of the justice system in this country as we know it. And he fought it.

The longer he spoke nonsense, the more incensed the people got. And yet, this judge kept distorting and kept suppressing.

People began to call ‘stand down’ from across the room. Others began to snigger.

Slowly and cautiously, the eyes of the solicitors, and some of the Garda present, began to avert, then lower, until some of their heads were bent.

It was shameful, and it felt dirty to be in a room with a judge, purporting to be fair, lawful, just and equal, when clearly, he wasn’t.

It was even more shameful to be in a room where this judge was placed under citizens’ arrest, and where our police force would not uphold their oath and do their job.

It took the people in the public gallery to do that. The stronger they became, the weaker Judge Kilrane got. His sitting ended with him, abandoning and surrendering his courtroom.

Instead, he continued sitting in his private chamber, a chamber that the public is not privy to.

Questions need to be raised here – how does the public learn if a miscarriage of justice has occurred if a case is being heard behind closed doors? Judge Kilraine cannot do this – it is not legal.

The excitement this morning in Castlebar, ended coincidentally with the fire alarm going off, not once, but twice.

Not one person left – not even the police. The fire brigade arrived, and asked people to leave. Some asked the firemen as to where was the fire, to which there was no reply.

As time went on, the official line that was given was that a person had lit a cigarette – in a cell. A cell, which one would imagine, was being guarded by the police.

Yet, astonishingly, in between the fire alarms, for the first time in decades, it was put democratically to the people to vote for a judge to sit in courtroom 1 – the same courtroom that Kevin Kilraine had abandoned.

Today, in Castlebar, ordinary, yet, extraordinary people made history – they voted for a ‘true’ judge. A judge with vision, a judge who upholds the law, and a judge who treats all as equals.

This historic day will create ripples that will spread throughout this country, and when the ripples take hold, the flood will come.

That spark that has ignited, has taken hold, and it is there for the people to keep.

There is no threat that any corrupt institution of this country, let alone the judicial arm, will have the strength to wrench that fire and fearlessness from the people.

In the YouTube sequence the 'judge' did not wear a robe or wig to signify that she was a judge. Are we supposed to view this takeover of an empty court seriously? The Gardai obviously didn't and engineered a bogus fire alarm.

Absolutely. Which makes this a very strange story. I can't imagine that a judge would issue a subpoena, the subpoena having been served, and then ignore when the persons did not show up in his or her court. So OK, please fill in the details for us.

a) who was the judge who issued the subpoensa? sitting in what court? I would think it VERY unusual for a judge to issue a subpoena for a case in a different court.
b) subpoenas duly served?

Private prosecutions are VERY difficult. Without ANY cooperating judges/magistrates, I would say impossible. A subpoena is a perfect example. You need somebody to issue it (service can be private; usually is in many civil cases --- it's what "process servers" do)

No wig or Robe is required to hear evidence and make a ruling based on that evidence.

The very fact that you seem to think the addition of a stupid Horse-Hair Wig and some bit of black cloth worn as a "Robe" are somehow required to in order weigh evidence shows just how deeply you have fallen for their little "legal" [NB: not "Lawful"] charade.

The fact that the Gardai decided to engineer a false fire alarm - by their own rules an obvious act of crime in itself - is evidence enough that there is a charade taking place.

The People's Judge action follows in the tradition of Thomas Davis. "Educate that you may be free" was the motto of his newspaper "The nation".
